HostGD Terms of Service

The HostGD Terms of Service, Otherwise referred to as the ToS is in place to help prevent users from being misinformed of our company rules and regulations, From time to time the terms of service may change, We reserve the right to change these terms without prior notice to the customer. We will do our best to ensure however all clients are emailed after any ToS Change is made.

By accepting the Terms of Service you also accept our Acceptable Use Policy and Privacy Policy

During this document HostGD (a Trading name of Globalised Data Group) will be referred to as “The Provider”, “We” or “Our”. The Customer/Visitor will be referred to as “You”, “Your” or “The Client”.

Refunds Policy
The provider offers a 7 Day Money back Guarantee on all Virtual Services, This includes Shared, Reseller and VPS Solutions, Dedicated & Backup Solutions are NOT eligible for refunds under any circumstances. The provider reserves the right to refuse a refund for services if the client violates any terms or any of the following but not limited to occur:

·         Over 50% Resource Usage within 7 Days.

·         Excessive Support/Management Requests.

·         Any violation of Terms of Service

·         Any violation of Acceptable Use Policy

·         Any form of SPAM Reports.

Some products are never eligible for refunds, These products are but not limited to:

·         Domain Registration

·         Dedicated IP Addresses (Shared, Virtual or Dedicated)

·         Unmetered Bandwidth Services

·         Management Tickets & Management Plans

·         Backup Space

·         Dedicated Servers (Including Hardware Upgrades)

·         Third Party Software (cPanel, DirectAdmin etc...)

Some products are eligible for refunds, These products are but not limited to:

·         Shared Web Hosting

·         Reseller Web Hosting

·         VPS Packages

·         VPS Hardware Additions (Dedicated Solutions such as HDD, RAM etc are not)

Client Data & Backup Responsibilities
The client is responsible for the safe keeping of their files, Under no circumstances can the provider be held responsible for loss of data. We provide backup services and these are protected, We are unable to accept responsibility for any data lost when a clients account is terminated or suspended.

Invoicing & Payments

·         The provider will Invoice ALL services 14 Days before the invoice is due, If an invoice becomes overdue the client will be given three days (Inclusive of Weekends & International Holidays) prior to account suspension,  Four days later the clients account will be removed from our servers. The client is then eligible to ensure that the outstanding invoice is paid within Seven days (Fourteen days overdue) And the account is cancelled using the correct procedure outlined in our Cancellations policy. If cancellation is not carried out in the correct manner the assumed service length is 12 Months and the client will be billed for the full outstanding amount for 12 Months from the date of signup.
 

·         Failure to pay will result in your account being passed to a financial collections agency of our choice in your country. This may incur further charges and in some countries may affect your credit file making it hard or impossible to obtain finance.

Cancellations Policy
All account cancellations must be processed in full by the account holder, This is done by entering your client area, Clicking “My Products & Services”, Selecting your product and Clicking the “Request Cancellation” Button at the bottom of the page.  If Cancellation is not carried out correctly then the client is responsible for all remaining invoices for 12 Months of service from signup date. Full information shown in the “Invoicing & Payments” section above.

IP Addresses
These remain the property of The Provider and the Business Group, They will under no circumstances be transferred out of the business.

·         Shared & Dedicated IP Addresses
These are either those given when a VPS or Dedicated Server is provided to a customer, They are not under any circumstances able to be transferred to another server within the providers network.
 

·         IP Blocks
These are IP Ranges bought after the deployment of a Dedicated Server, These can be transferred between servers within the providers network. A onetime fee of $25.00usd will be payable for the transfer of IP Blocks within the network.

Suspension & Termination
The provider reserves the right to Suspend or Terminate services without prior notice to the customer, Some reasons for such include but are not limited to:

·         Consistent Account Attacks (DOS/DDOS Inbound or Outbound)

·         Excessive Violation of Company Policies (TOS/AUP/PP)

·         Chargebacks or Bounced Payments

Service Level Agreement (SLA)
The provider offers a 99.9% Uptime Guarantee, This is excluding all but not limited to:

·         Scheduled Maintenance

·         Emergency Security/Software Updates.

·         Account Suspension or Termination.

In the event that our system uptime for a month is less than 90% A discount of up to 50% for the next months service will be given. (This is excluding Dedicated Services).

Account Responsibility
The account given to the customer when they signup to our services is to remain the property of the provider however the responsibility of the Client. This is under no circumstances to be transferred, It is your responsibility to ensure that emails from our system are being sent to the correct address (Your default contact in the Client Area).

Account Transfers
For the event of an account being transferred to another user the client must first email billing@hostgd.com giving the reason, 2 Forms of Identification (Both showing Name & Address, At least one of them showing a photo of the clients face.) This email must come from the address on file in the Client Area, And the new account holder must also email billing@hostgd.com giving the clients full name/address/telephone number and 2 eligible forms of identification (Same requirements as above). The new account holder will need to wait until the Billing team have setup an account, There will be a charge of 1 Months service Advance Payment required by the New account holder before the product can be transferred.

Clients who fail to follow this information will be suspended for 7 days, If the account holder has not made contact within 7 days eligibility for refund will be revoked and services terminated. Data loss is likely at this point.

Fees & Charges
Some of the Charges that The provider is entitled to make against Any client include but are not limited to:

·         Company Policy Violation: Up to $50.00usd

·         Chargeback & Bounced Payments: Up to $50.00usd Per Transaction

·         Manual Payment Requests, Administration Charge: $5.00usd Per transaction.

·         Account Transfers: 1 Month of Service (Minus Setup Fee’s)

·         IP Block Transfers: $25.00 onetime Fee.

·         Administration Charges: Up to $100.00usd

·         Operating System (OS) Reload Fee: $30.00usd

·         VPS Support (Non Managed Clients): Up to $10.00usd Per Hour

·         Dedicated Server Support (Non Managed Clients): Up to $30.00usd Per Hour

·         Reactivation Charges:  Up to $50.00usd Per Service

·         Late Payment Fee: $5.00usd Per Service for Every 7 Days Overdue (Up to $10.00usd Total)

Other charges may be introduced without prior warnings.

Zero Tolerance to Spam & Fraud
The provider takes a very low tolerance on any Spam or Fraudulent Services, All accounts falling into these categories maybe terminated without notice.

Disclosure to Law Enforcement
Any request made in righting from Any International Law Enforcement will be fully co-operated with, The provider cannot be held responsible for incorrect information being given at the time of signup for any client.

Fraud Screening
The provider holds the right to request The Client Validates there account at any given time, Any request for such information that is not responded to within 48 Hours will be terminated.

PayPal & Credit Card Validation
When a client registers if the PayPal Account or Credit Card used to make payment is not registered in the same name as the account holder we may request 2 forms of Identification and a short form to be filled by the PayPal Account/Credit Card Holder and returned to The Provider within 24 Hours. Any order Maybe delayed or denied until this is completed.

Storage of Sensitive Data & Identification
Your identification can only be sent to the provider via Email directly to the company, This data is stored on a flash disk at the providers headquarters. This flash disk is encrypted and clients data is not stored in any way accessible from the internet, All inbound emails are automatically removed from the mail server as soon as they are downloaded by the operating party.

Special Offers & Invalidation
From time to time The provider may advertise special offers, Some with and some without coupon codes, By Violating our Terms of Service, Allowing your Invoices to go into suspension stages will invalidate your Special Offer Discount/Rewards. At such time The provider reserves the right to amend billing information on your behalf.

Instant Setup (Shared & VPS Customers Only)
Our Shared and VPS Customers are offered Instant Account activation, This however is not a 100% Guarantee that you will be given your account information within a few seconds, Our systems flag random orders and those that look suspect for fraud checking, In this event any account setup maybe delayed whilst an administrator verifies your order.

Setup Times (Dedicated Servers)
Our typical server setup time is within 24 Hours, However we do not guarantee anything less than 72 Business Hours for Server setup as during peak sales hours workload could be higher than usual or stock levels can be lower. We do our best to ensure all servers are delivered within 24 Hours.

Failure to Read Company Policy
It is the responsibility of the customer to read both the Terms of Service, Acceptable use Policy and Privacy Policy prior to registering with The Provider, By signing up to our services you are required to accept the Terms of Service outlined in this document and the Acceptable Use Policy. Failure to read such Terms does NOT exclude you from being strictly bound by these terms.
